These Terms of Use (“Terms”) govern your use of mycondoexpert.com and its language versions (the “Website”). The Website is operated by My Condo Expert, an initiative of COSMORE. By using the Website you agree to these Terms. If you do not agree, please do not use the Website.
1. Brokerage services
Real estate brokerage services are provided only by appropriately licensed entities and individuals:
– Cosmore Florida Corp. (d/b/a COSMORE), Florida real estate brokerage, for properties and services in Florida;
– Cosmore NY Corp., New York real estate broker, for properties and services in New York.
Nothing on the Website is an offer to provide brokerage services in a jurisdiction where the relevant entity or professional is not licensed. Using the Website does not by itself create a brokerage, agency or fiduciary relationship. Such a relationship arises only as provided by applicable law and any written agreement (see our Brokerage & License Disclosures).
2. Information only; no professional advice
Content on the Website, including guides, articles, neighborhood pages, market commentary and calculators, is general information. It is not legal, tax, financial, investment, immigration or insurance advice. Consult qualified professionals before making decisions.
3. Listing information
Listing information is provided in part by multiple listing services through Internet Data Exchange (IDX) programs. It is deemed reliable but is not guaranteed. It may be inaccurate, incomplete or out of date, and properties may be subject to prior sale, change or withdrawal. All information, including square footage, measurements, school information and association fees, should be independently verified. IDX information is provided exclusively for consumers’ personal, non-commercial use and may not be used for any purpose other than identifying prospective properties consumers may be interested in purchasing or renting. 4. Permitted use
We grant you a limited, revocable, non-exclusive, non-transferable license to use the Website for lawful personal purposes. You agree not to:
– scrape, harvest or copy listing data or other content by automated means;
– republish, sell or commercially exploit Website content;
– interfere with the security or operation of the Website;
– submit false information or information about another person without their authorization;
– use the Website in violation of fair housing or other laws.
5. Intellectual property
The Website, its design, text, graphics, logos and original content are owned by or licensed to COSMORE and its affiliates and are protected by intellectual property laws. Listing photos and data belong to their respective owners and licensors.
6. Copyright complaints (DMCA)
If you believe content on the Website infringes your copyright, send a notice under 17 U.S.C. ยง 512(c)(3) to our designated agent: Gabriele Corio, Cosmore Florida Corp., 1200 Brickell Avenue, Suite 250, Miami, FL 33131 ยท g.corio@cosmore.com. Include:
– your signature;
– identification of the work and of the infringing material, including its URL;
– your contact information;
– a statement of good-faith belief that the use is not authorized;
– a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act.
7. Communications
By submitting a form, you agree that we may contact you in response to your request. Calls and text messages are made only as described in the consent language on the form and in our Privacy Policy.
8. Third-party links and services
We are not responsible for third-party websites, services or content linked from the Website.
9. Disclaimer of warranties
The Website and its content are provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by law, COSMORE, its affiliated entities and their officers, directors, employees, brokers, licensees and agents are not liable for indirect, incidental, special, consequential or punitive damages arising from your use of the Website. This section does not limit liability that cannot be limited by law, or obligations arising from a separate written brokerage agreement.
11. Indemnification
You agree to indemnify COSMORE and its affiliates against claims arising from your misuse of the Website or violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida. For matters relating to New York properties or services, the laws of the State of New York govern where required. This does not override mandatory consumer-protection, licensing, agency or real estate laws applicable to a particular transaction.
13. Changes
We may modify these Terms. Continued use after changes take effect means you accept the revised Terms.
