Brokerage relationships in Florida. Under section 475.278 of the Florida Statutes (https://www.flsenate.gov/Laws/Statutes/2026/475.278):
– Florida licensees may work with buyers and sellers as transaction brokers or as single agents, or may have no brokerage relationship.
– It is presumed that all licensees operate as transaction brokers unless a single-agent relationship or no brokerage relationship is established in writing.
– Florida law does not allow dual agency.
– A transaction broker provides limited representation. A single agent owes fiduciary duties, including loyalty, confidentiality and full disclosure.
– The required disclosures of duties are provided in writing as the law requires.

Agency disclosure in New York. New York Real Property Law ยง 443 requires real estate licensees to give consumers an agency disclosure form at the first substantive contact.
